Controlling Illicit Trade of Tobacco in the Era of Fast Change
About the project
This research project serves to identify trends and required modifications in the control of illicit trade in tobacco products in the European Union (EU), taking into account a number of recent political, legal and technological changes (e.g. the Brexit referendum, the decision of the European Union not to prolong the trade agreements). International team of experts from Germany, Italy, Lithuania, Poland, Romania, Slovakia are responsible for preparing national reports on the illicit trade in tobacco products. In the next step there will be prepared the horizontal report showing recommendations and best practices in the fight against illicit trade in tobacco products. The results of the research will be published (book in English) and presented during the international conference in Warsaw at the Institute of Law Studies Polish Academy of Sciences in December 2019.

- The role of criminal law in fighting illicit trade of tobacco products
- The proper role of intellectual property (IP) laws and enforcement mechanisms in controlling counterfeiting
- The impact of Brexit on tobacco illicit trade control in the EU
- EU-tobacco industry agreements and beyond
- Public-Private Partnership
Project objectives
- Analyse trends, mechanisms, law and system that will inform the relevant police-makers and enforcement agencies on available options to reduce illicit trade in the EU.
- Show the international perspective of controlling illicit trade of tobacco products.
- Preparing report on the role of criminal law in fighting illicit trade of tobacco products in Germany, Italy, Lithuania, Poland, Romania, Slovakia.
- Examine the proper role of intellectual property laws and enforcement mechanisms in controlling counterfeiting of tobacco goods.
- Provide a basis for identifying deficiencies in existing models and proposing concrete guidelines and recommendations for policy-makers and enforcement agencies (both at the national and European level) on the most effective ways for combating illicit trade in tobacco products.
- Broaden the current public discussion on the problem of illicit trade in tobacco products.
