Introduction into the seminar: By establishing minimum requirements of protection for intellectual property rights the TRIPS Agreement has changed the landscape of IP worldwide. The notion of IP standards has become a commonly accepted concept (not to say a standard) in the legal doctrine. The minimum requirements provided in TRIPS do not lead however to a full standardization – they are divergent in many aspects. It is thus the aim of the seminar to present and discuss chosen aspects of both standards and lack of standards in the protection of IP.

How are the TRIPS minimum requirements regulated in particular fields of IP? Are the mandated standards always implemented into national laws? What aspects of intellectual property are left to the discretion of national or regional authorities and where the standardization is the most far-reaching? Finally, what standardization instruments have been used in IP since TRIPS? These and other questions will inspire our discussion.

We would like to invite academics, PhD candidates, students and practitioners interested in the law of intellectual property to participate in our seminar.

SPEAKERS:

Shubha Ghosh 

BIO: Dr. Shubha Ghosh earned his J.D. from Stanford University, with distinction, and his Ph.D. in Economics from the University of Michigan. He earned his BA, cum laude, from Amherst College. Prior to joining Syracuse University College of Law, Ghosh taught at the University of Wisconsin Law School (ranked as a top thirty law school by US News) as a chaired, tenured professor and co-director of the Innovation cluster, consisting of faculty in the law and business schools.

ABSTRACT

Elżbieta Traple 

BIO: Elżbieta Traple is a senior partner and co-founder of the law firm Traple Konarski Podrecki i Wspólnicy. She is a researcher at the Chair of Civil Law at the Jagiellonian University. Her areas of interest include civil law and intellectual property law. Her academic interests also include unfair competition law, industrial property law, and pharmaceutical law. She advises Polish and foreign companies and entities from the public sector.

BIO: I am the associate professor in the European Economic Law Department, Faculty of Law and Administration of the University of Łódź, Poland. Moreover I am Polish patent attorney. I graduated from the University of Łódź in Poland with the master of law degree, and studied at Westfälische Wilhelms University in Münster (Germany) as Erasmus student.

BIO: Łukasz Żelechowski is Assistant Professor at the University of Warsaw, Faculty of Law and Administration, Department of Intellectual Property Law. He is also Of Counsel at LDS Łazewski Depo i Wspólnicy, Warsaw, and Arbitrator at the Arbitration Court for Domain Names at the Polish Chamber of Information Technology and Telecommunications. He is qualified Polish patent attorney.

BIO: Żaneta Pacud graduated in law and European studies at Adam Mickiewicz University in Poznan. She obtained her PhD in 2012 at the Jagiellonian University in Cracow. For her dissertation, devoted to patent protection of medicinal products, she was awarded by Ministry of Science and Higher Education in the contest for the best doctoral thesis in the field of intellectual property.
